1. Agreement to Terms

By accessing or using https://kffdef.com (the “Site”) and any related services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

The Services are intended for individuals at least 18 years of age. By using this Site, you represent that you meet this requirement. We reserve the right to modify these Terms at any time.

2. Firearm and Legal Compliance

All applicable federal, state, and local laws apply. It is solely your responsibility to understand and comply with all firearm, ammunition, and accessory laws in your jurisdiction.

FFL Transfers

Serialized firearms will be shipped only to a valid Federal Firearms License (FFL) holder. By purchasing a firearm, you agree:

• You are legally permitted to own a firearm.
• You will designate a valid FFL dealer who must provide a license copy before shipment.
• You are responsible for all transfer fees.
• Failure to pass a background check does not entitle you to a refund.
• If a firearm is returned due to a failed check or refusal, you may be subject to restocking fees and return shipping costs.

3. Ammunition Sales

By purchasing ammunition, you certify that you meet all legal age and eligibility requirements. We reserve the right to cancel ammunition orders that violate local laws.

4. Products and Availability

We strive for accuracy in descriptions and pricing. However, availability is not guaranteed, specifications may change without notice, and we reserve the right to discontinue products or cancel orders at our sole discretion.

5. Minimum Advertised Price (MAP)

Certain products are subject to manufacturer MAP policies. We reserve the right to adjust displayed pricing to comply with these agreements, refuse sales to resellers, or cancel orders intended to circumvent these policies.

6. Purchases and Payment

All payments are processed securely through Shopify. By placing an order, you authorize us to charge your selected payment method for the total amount, including applicable taxes and shipping fees.

7. All Sales Final

All sales are final. Due to the regulated nature of the products sold, refunds are not guaranteed. Please review our Refund Policy for complete details.

8. Prohibited Activities

You agree not to use the Site for unlawful purposes, violate firearm laws, interfere with Site security, or use automated systems (bots/scrapers) to access the Services. Violations may result in account termination.

9. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials. We reserve the right to suspend or terminate accounts at our discretion.

10. Reviews and Submissions

By submitting feedback, you grant us a non-exclusive, perpetual license to use that content. We reserve the right to remove any content that violates laws or third-party rights.

11. Privacy

Your use of the Site is governed by our Privacy Policy. By using the Services, you consent to the data practices described therein.

12. Disclaimer

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES. KFF DEFENSE LLC IS NOT RESPONSIBLE FOR PRODUCT MISUSE, CRIMINAL USE, OR REGULATORY VIOLATIONS BY THE USER.

13. Limitation of Liability

OUR LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

14. Dispute Resolution and Arbitration

Informal Resolution: Parties agree to attempt informal resolution for 30 days before initiating proceedings.

Binding Arbitration: Disputes shall be resolved exclusively through binding arbitration in Kentucky under the American Arbitration Association rules. You waive the right to a jury trial or participation in class actions.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky.

16. Indemnification

You agree to indemnify KFF Defense LLC from any claims arising from your misuse of the Services, violation of these Terms, or violation of applicable law.

17. Electronic Communications

By using the Site, you consent to receive electronic communications and agree that electronic records and signatures satisfy legal requirements.

18. Miscellaneous

These Terms constitute the entire agreement. If any provision is found unenforceable, the remaining provisions remain valid. Failure to enforce a provision does not constitute a waiver.
